Introduction

Motor Kiwi (“we”, “us”, “our”) provides a private assisted sales service to help individuals sell their vehicle.

Motor Kiwi is not a vehicle dealer and does not own the vehicles listed. We operate solely as a facilitation service between private sellers and prospective buyers.

By using our services, you agree to these Terms & Conditions.

Business identity: Motor Kiwi, private assisted vehicle sales facilitator.
Nature of our role: We connect private sellers with buyers; we are not a trader, dealer, or seller.
Sale type: All vehicles are private sales between buyer and seller.
Fees: Any buyer consultation or facilitation fees will be disclosed before payment.
Cancellation rights: As this is a private sale between two individuals, statutory 14-day cooling-off rights do not apply to the purchase of a vehicle.
Complaints: Complaints about Motor Kiwi can be made via email or phone. Complaints about a vehicle must be directed to the seller.

Service Description

Motor Kiwi provides:

  • Advertising and marketing assistance

  • Handling of enquiries

  • Facilitation of negotiations

  • Administration of appointments and viewing arrangements

  • Support with payment arrangements between buyer and seller

Motor Kiwi:

  • does not buy or sell vehicles

  • does not inspect vehicles

  • is not a party to the sale contract

  • offers no guarantees regarding condition, quality, history, or performance

The final sale contract is exclusively between the seller and the buyer.

Seller Terms

If you choose to sell through Motor Kiwi, you agree to the following:

Accuracy of Information

You must provide full, honest, and accurate information about the vehicle, including defects, damage, faults, and history.

You accept full responsibility for any misrepresentation, omission, or inaccuracy.

Exclusivity Period

Once you engage Motor Kiwi, you agree:

  • not to advertise or sell the vehicle privately elsewhere

  • not to negotiate directly with buyers

  • to direct all enquiries to Motor Kiwi

  • to notify us immediately if a buyer contacts you directly

Breaking this term may lead to termination and recovery of Motor Kiwi’s expected commission.

Viewings

You remain responsible for physically showing the vehicle to buyers.

Seller Indemnity

You agree to indemnify Motor Kiwi for any losses, claims, or legal action resulting from inaccurate information you provide.

This includes:

  • incorrect vehicle descriptions

  • undisclosed faults

  • misrepresentations

  • disputes arising from the sale

Buyer Terms & Conditions

All vehicles sold through Motor Kiwi are sold as seen, tried, and approved by the buyer.

By purchasing a vehicle, you acknowledge that:

This is a private sale, not a sale from a motor dealer.

Inspection Responsibility

You are fully responsible for:

  • inspecting the vehicle in person

  • carrying out checks (HPI, MOT, service history)

  • verifying mileage, condition, features, and suitability

You must not rely solely on the advertised description.

Because this is a private sale:

  • no warranty is provided unless obtained from our third-party provider.

  • no guarantees are given

  • after-sale are not made to Motor Kiwi.

Any post-purchase issues are to be addressed directly with the seller.

Buyer Fees

Any consultation or facilitation fees paid to Motor Kiwi are non-refundable, regardless of vehicle condition or outcome.

Advertising Disclaimer

Vehicle descriptions shown on our website, social media, or other platforms are:

  • provided directly by sellers,

  • adjusted or reformatted for readability,

  • and may include AI-generated text based on the seller’s supplied information.

Motor Kiwi:

  • does not guarantee accuracy

  • does not inspect vehicles

  • accepts no liability for inaccuracies, omissions, or errors in the description

Buyers are urged to rely solely on their own inspection and checks.

Payments

Payment for vehicles is made directly from the buyer to the seller unless otherwise arranged for administrative purposes.

Motor Kiwi never takes legal ownership of the vehicle at any stage.

Commission is charged according to the consignment agreement.

Data Protection

We respect your privacy and commit to protecting your personal data. Personal data will be processed in accordance with UK GDPR.

Liability

Motor Kiwi is not liable for:

  • any mechanical, cosmetic, or electrical issues with the vehicle

  • inaccuracies in seller-provided information

  • future faults or repairs

  • losses arising from buyer reliance on an advertised description

  • disputes or claims between buyer and seller

Motor Kiwi’s liability is limited strictly to the scope of its facilitation service.
Nothing in these terms limits liability where it would be unlawful to do so.

Termination

Motor Kiwi may terminate services where:

  • sellers provide false or incomplete information

  • sellers breach exclusivity

  • parties behave abusively or fraudulently

  • terms are violated in any way

Amendments

These Terms & Conditions may be updated at any time.
Changes take effect when published on this website.
